Hi Everyone,

I'm the cyclist who supplied this footage to the police, then subsequently uploaded it to Youtube. Quite a surprise to come across this thread here!

I'll respond to some of the criticisms against me. Firstly, my cycling is not perfect throughout the video. However, it is safe and courteous. I do make a couple of minor mistakes at a couple of points later in the footage, but I spot them and correct them safely. Part of the reason I film my rides is to see if there's anything I do wrong or fail to anticipate, and if there's anything I can learn from the footage.

I supplied the full footage to the police to make it clear that I had nothing to hide. There were no previous altercations with the driver before I positioned myself ahead of him at the lights. Had I known they would comb the footage for excuses to let the driver off, I might not have been so transparent.

In the footage, I position myself safely in the cycle box behind the moped. When the lights change I initially set off following the moped, accelerating quickly, until I spot the bus on the left signalling to pull out, so I slow down and take a wide line to accommodate the bus. The driver didn't pull out so I accelerated again into the 20mph zone. I was doing at least 20mph after this point so taking the lane really shouldn't be an issue here with anyone.

Following the incident - point taken, I was holding the primary at a slower speed, which I shouldn't have done (and normally wouldn't). I was still pretty shocked here and just gathering my senses. It was either a case of continue in the primary for a bit (I didn't want any further overtakes immediately) or pull off the road completely and wait a couple of minutes. I probably should have done the latter. However I also wanted to follow the driver and see if he pulled any further dangerous stunts, or if I could get a clear shot of his face. So that's the decision I made. Thankfully the other drivers around me were respectful enough not to try anything stupid.

I am writing up a blog dealing with my experiences with the police. I'm pretty shocked by their response.

Do you do realise the road narrows? That there are parked vehicles? The cyclist could use any part of that lane, especially if they need to avoid pot-holes and uneven surfaces. Regardless of whether the cyclist was to the left, centre or right, the responsibility is on the driver to over-take correctly.. clearly they chose not to. Blaming the cyclist is just blaming the victim of the driver's idiocy.

Have to agree - BMW driver needs extended driving test but so does the cyclist if one was available
@ 12.55 (in the longer version video the cyclist is in a right turn lane but then changes lane into the straight on lane.
I'm all for taking primary "when necessary" but there's taking primary and taking the piss

Not defending the BMW driver (and never would) but as a fellow cyclist I can't see how you can defend cycling in this position as reasonable "taking the lane."

Moving at the speed limit. There's literally no problem in taking the lane if I'm not holding anyone up who's travelling at the legal limit.

You're cycling in the middle of the road as soon as you set off from the lights! Pull over to the left and allow the traffic to pass! You were asking for a reaction from holding up the driver behind. Idiot.

Middle of the road? Then so was the car. The cyclist has every right to ride primary including to deter stupid over-takes. If you look, riding to the left would have put the cyclist in the door zone. The only thing holding up the driver was their own arrogant selfishness.. can use full lane get used to it.

Whoever said that should be fired. How can not using a cycle lane be mitigating circumstance when they are NOT compulsory; that the choice made by the cyclist is to be done so WITHOUT PREJUDICE? That copper seems to be as as bad as that driver! I'd seriously contact the Police Complaints Commission over this - as well as the media.
