Apparently seen using a mobile device whilst in the outside lane. Edited image to remove passengers and company logo.

Sir, why on earth create such risks, both yourself and to your passengers? Crazy.

I do not see why any passenger(s) should be in these pictures, when they are clearly not liable for the driver's actions. If someone lights a fag on a bus does that mean everyone else should be fined for smoking? Of course not. Furthermore it could have ramifications for them in or outside the workplace, despite the fact their actions are purely born of circumstance and not choice. I do not think it's fair to tarnish them with the same brush as someone using a phone whilst DRIVING and for that reason I will not upload their faces.

Peter, if the passengers were guilty then it would be they who would be fined. The passengers cannot be held liable for something they have not done because the legal responsibility does not rest with them. When was the last time a passenger got fined for the driver using a phone at the wheel?

Furthermore what makes you think the passengers agree with the driver's actions? I think you're arguing a mute point because the responsibility is on the person in charge of the vehicle first and foremost, not them, as passengers. Whether or not they agree with a driver using a phone is irrelevant and would not hold up in court because you're basically trying to blame them for something they are not guilty of..

I also think you're being highly presumptuous regarding the outcome of this report. The company has already been named..the company will be fully aware of the registration especially when it has been posted in the general media. What makes you think the driver won't face question? What makes you think the company mentioned here, doesn't care about this report? What makes you think they automatically condone such behaviour? They cannot have eyes and ears everywhere and these things happen in many companies, big and small.

By removing the logo you are preventing this driver from being rebuked for his crime meaning that he will continue doing this until he is caught or it leads to an accident.
The passengers are not innocent. They are sitting there allowing the driver to commit a crime so are complicit.

OK Anon, I left them out because they may not condone the driver's actions.

Where the company is concerned it may be a Ltd company and therefore not be aware or for that matter condone the actions shown. If it's a sole ownership company then naturally it's different, but this does not appear to be the case (unless the CEO drives around in a van using a phone?).

AS regards the passengers, I fail to see how they were in any way responsible and as such all I want to do is protect their privacy.

Anyway, the company was reportedly

ESL Landscape Contractors.

Hope this helps.
