This would fail the driver on a test. Had they passed, it is my opinion they'd stand a good chance of being prosecuted. It's blindly obvious one shouldn't be over-taking there; it's a double pinch-points on the approach to a summit, for Christ's sake.. how clear does it have to be?

So why do it to a vulnerable road user. There is no justification for what that driver did and any reference to cycling on pavements and/or shared use facilities is not relevant - the cyclist had every right to be where they were and without malic especially from road rage morons going around threatening people with their vehicle.

The cyclist wasn't "all over the road", at any time. Prove otherwise. The cylist remained in their lane at all tmes; if anything they afforded the driver more room than they should have; the recommended course of action for pinch points is to ride primary.
The cyclist was not in the middle of the road when the van was behind them. I also note you avoid any mention of the driver's terrible attitude- tail-gating; horn abuse; attempting to to over-take through a pinch-point; attempting to use their vehicle as a weapon. See how far you or that driver would get in a court attempting to justify such behavour.
The responsibility is on the driver to over-take when it is both safe and practical. It was neither. That cyclist almost lost their life on account of the wilful and dangerous negligence of someone driving whom I can only drescribe as a complete moron who should be banned off the roads, in my opinion.
p.s. I cycle and drive. PLEASE, if you're serious about safety, brush up on cycle positioning and where and when not to consider over-taking. Thanks.
