Shouldn't have been undertaking!! Although Fiesta should have checked mirrors better. There was no reason you couldn't have legally overtook from what I could see, rather than illegally undertaking in such bad conditions.

When flowing traffic on a motorway changes it's quite legal to pass on the left. Basically had the Fiesta (and many other inconsiderate "this is my second castle and I own the road" drivers) followed the Highway Code the "uploader" would not be put in a position to pass on the left.
Note I didn't use the other term as it's been replaced by careless driving among other potential charges.
The only careless driver was the Fiesta in this instance.
Had the "uploader" been lane hogging in lane 2 and changed to lane 1(left lane) then clearly they would be breaking the law.

Read the highway code. You must go into the left hand lane as soon as you have finished overtaking. You should not move into the left hand lane with the intention of overtaking but if you are in the left hand lane and due to queue the traffic us moving faster in the left hand lane then it is perfectly OK to overtake traffic moving slower in the middle lane. The guy in the middle lane should check mirrors and wait until it is safe to make his move.

Nearly a crash on the M25 with this one, tried to merge without checking blind spot, nearly swiped me off, luckily I was already moving back to give him/her room to merge otherwise it could have been worse.

Well you shouldn't have been attempting an undertake in the first place. Especially in speed restricted roadworks where the lanes are about to narrow. That driver had enough to think about without you creeping up the inside as well.
I don't condone the driver middle lane hogging and they should have checked their mirrors earlier - they probably checked the mirror while manoeuvring when you'd already crept into the blind spot.
If you had just gone around to lane three to do a legal overtake instead of an illegal undertake then this wouldn't have happened.

I am the driver of this vehicle. Interesting that the dashcam video has been removed, perhaps because the dashcam car didn't have his lights on! I would of seen him better then, for sure ;)
