Yes it's every drivers responsibility to ensure their vehicle is "fit" for purpose / road legal etc

It could of happened 2 minutes before you saw the vehicle - nobody can know for certain.

My approach would be to hit the horn and flash the driver to gain their attention and let them know and if the driver says "Yeah I know" then upload the video showing this
