Off duty or not it doesn't matter.
I know helmets are not compulsory but these days you must be half brain dead already if you choose not to wear one while cycling.

I am more concerned with the driving. I don't like to make fun of people's appearance as I think it cheapens the argument into petty insult.

What is the driver's problem? The cyclist was with traffic flow - the cyclist IS traffic. The cyclist was also negotiating door zones - just as cars do. The cyclist was also in front, with plenty of room for cars behind to see what they were doing as long as they didn't drive like a bat out of hell.
The van driver however was clearly going fast.. so fast in fact that he appeared to veer sharply to avoid a car turning into a side-road. Here's a tip mate: bloody drive in accordance with the conditions and not your personal desire to match or beat the speed limit. I actually think the guy cares, to an extent; however he doesn't quite understand his responsibilities. If cyclist welfare matters so much to him then driving like that isn't showing it.
p.s. Please avoid the trolls on here trying to turn this into an "anti-cyclist" rant. They are a common problem on the Internet..please don't feed them.
