The problem is, the van will be found at fault for tailgating, and quite right too. The fact that the car in front instigated the animosity with his terrible parking, and then responding to the tailgating with his brake checking is completely irrelevant as far as the insurers will be concerned. It's a shame that only one driver will be punished when they should both be taken off the roads permanently - because they clearly both have serious ego issues that are a danger to us all.
