"They dont have a dashcam". You are speculating. It won't stand - it would not be considered reliable evidence; it would be considered your word against someone else's because you have no "definitive" evidence.

The photo is taken from the drivers seat and the major bit of evidence to suggest the driver took it is that the driver said he took it , maybe double the amount of reading you will do this year by reading a couple more comment .

Oh yes my apologies the law does allow people to be in control of a motor vehicle and using a mobile phone to take pictures especially after an incident in which they claim to have been brake checked it's safer if he does it again to be holding your phone , I'll do some dots as well now ..........
