Speed limit on that stretch at the time was 50mph with averaging speed camera, speed of the vehicle recording was 45-50mph. If you really wanted to break to law you could have chosen to over take on the outside lane instead of undertaking the VW using the hard shoulder causing it to manouvre to the right slightly.
The footage leading up to the recording uploaded shows a steady Increase in speed of the vehicle recording. The VW increased speed as the BMW approached from the rear.
One lesson you can learn from this.... TWO WRONGS DON'T MAKE A RIGHT
