Just to point this out..

"not enough room to overtake (1.5m by law)"

A big problem here is that in reality there is no law governing the stated passing distance. It is only guidance.

However, it can be used against a driver when taking into account the charges of careless, dangerous or reckless driving, or driving without due care and attention.

Even in such cases, you mostly need witnesses and if providing video evidence, it has to be clear and compelling. Another problem is that many forces simply aren't prepared to get off their rears and follow through complaints. This despite the risk these drives can and often do, cause to human life.

Britain is a very backwards country when it comes to cycling funding, provision, awareness and education. No wonder so many people are put off.

From west midlands police website:

What is the close pass cycling initiative?
We became the first force in the country to proactively target "close pass" drivers who endanger riders.

Rules of the road say motorists should give cyclists at least the same space as vehicles when overtaking.

Anyone encroaching inside that safe passing distance - widely considered to be a minimum of 1.5 metres - runs the risk of being prosecuted for driving without due care and attention.

Officers saddle up on some of the region’s busiest routes looking out for motorists who put cyclists at risk. They will radio the details of close-pass drivers for in-car colleagues to stop drivers.

Drivers will be offered a road-side educational input on safe overtaking but repeat offenders, or anyone deemed to have driven dangerously close to a cyclist, can expect to be prosecuted and taken to court.

How can I report close pass drivers?
We can now take online reports of close pass drivers, as well as dangerous driving, as well as careless driving and using a mobile phone while driving.

In order for action to be taken, you will need to:

Know the alleged offending vehicle’s number plate.
Be able to upload video footage, for example dash cam/cycle cam footage.
Have independent witnesses or evidence of the alleged offence.
Be willing to attend court and give evidence.
If you are happy with all of the above and wish to proceed, visit our online reporting portal.

Please note, the above link is for reporting incidents that have occurred within the West Midlands area. If you wish to report an incident that occurred outside the West Midlands, follow this link.

If you do not have video evidence, but you do have other supporting evidence, such as an independent witness, the vehicle’s number plate and you are willing to attend court, please download this form, complete it and email it back to us.

i agree with the top commenter. I got blocked in at a red light, guy got out to abuse me for not using the shared path[ at 20 mph, that goes through where people walk out in front of you to cross over] he pushed me off the bike into oncoming traffic, called me a silly cunt etc. Took crystal clear vid evidence to cops, full statement given, nadda, nothing, nothing heard back. The police either havent got time, or the ones that do dont like cyclists either. Im never reporting anything again.

hes braking id imagine because he hasnt the foresight to spot the oncoming car, nor has he the understanding that if that car door opens youll be flung into his vehicle and be killed or very injured. Hes made you slow down by overtaking, then braking, which is also very inconsiderate and a hate of mine when i cycle. If they do this, dont brake, crash into them. its their fault for overtaking. if you then come off the bike its them who'll end up in court for forcing a vulnerable road user off the road. from a driver, biker and 6000 miles per year cyclist.

Even with your common sense approach and experience, some people simply do not want to listen or read. Some people hate cyclists and think the rules don't apply to them, and as such they can create their own laws for their own benefit.

Cycling is dangerous at the best of times. So is driving. But cyclists are particularly vulnerable - they NEED space. They CAN use the lane accordingly, which means controlling the space around them where required and regardless of the speed limit.

I lose count the number of times every single day I see cars being driven in a threatening, dangerous and otherwise illegal manner, around cyclists. The rules fly out the window and unless the cyclist is hit, the moronic attitude behind the wheel does not care. Hence the reason cycle cams are so popular including as an added insurance policy against violent, dangerous drivers routinely attempting to pervert the cause of justice just so they can take it out on innocent people going about their lawful business.

Not to said mob. Your days of running wild are becoming increasingly limited. You might think you can run but you can't hide from the law, and if you are not prepared to share the road - including withe cyclists, accordingly, then WALK. Life owes you no explanation for your shit attitudes and driving.

It's difficult to tell about the over-taking part but it looks to me that he braked because of a parked car on the left (ie on his side of the road), which he is unlikely to have seen before over-taking you, and with a car heading towards him he is obliged to give way to the oncoming vehicle given the obstruction was on his side of the road. Maybe you're looking to make too much of this? Given the picture, I would also say the distance between him and you at the over-taking point is debatable.

'Maybe you're looking to make too much of this?'

Maybe you're not looking enough.

If the over-taking vehicle does not have a sufficient view, among other things (see below), then the rules are simple: don't over-take.

I think you should also understand the lack of requisite distance - the cyclist needs to be at LEAST a door's length away from parked vehicles - this isn't the case in the picture shown, as the over-taking vehicle is sandwiching them into the "door zone". The lens on the camera may may it look wider than it is, but the cyclist has almost no escape route.

If the driver over-taking does not have sufficient, view, or over-taking distance then they simply should not be over-taking.

I can appreciate what your saying with regards to parked cars however the pictures don't show that prior to the overtaking manoeuvre the driver failed to give room (1.5m is the whole of the road if cars are parked) (and would have seen the approaching car) and could have slowed down to prevent nearly causing an accident. Lucky for me I have good brakes.
